IRR Submission to the Select Committee on Transport, Public Service and Administration, Public Works and Infrastructure, National Council of Provinces, regarding the Expropriation Bill [B23-2020]

In this submission the IRR demands that the Bill be thoroughly amended to come in line with, inter alia, Section 25, 33, and 34 of the Constitution by deleting provisions for nil compensation, explicating considerations that benefit private owners, and assuring that expropriations cannot take place until after agreement or court review rather than before. In addition definitions are challenged, especially that which could allow nationalization by the parallel process of custodianship, procedural defects are identified and a constitutionally sound alternative is laid out.
