The Institute of Race Relations (IRR) will host an online media briefing on Wednesday at 10am on its latest report, Civil Liberty in South Africa: Freedom Under Law Three Decades After Apartheid.

This comprehensive paper by Martin van Staden, Head of Policy at the Free Market Foundation and former IRR Deputy Head of Policy Research, delves into the foundations of civil liberty, assesses South Africa's progress since 1994, and offers crucial recommendations for enhancing the role of civil liberty within our constitutional framework.

In Wednesday briefing, Van Staden will:

  • Outline recommendations for the courts, Parliament, and the executive in promoting and upholding civil liberty;
  • Recommend a new approach to section 36 (on assessing whether limiting constitutional rights is justifiable) that would truly respect the logic of this provision;
  • Propose the adoption of a comprehensive package of legislation that recognises and safeguards different dimensions of freedom under the law; and
  • Emphasise the importance of inculcating respect for civil liberty within the civil service, as protecting civil liberty should be the government's foremost social purpose.
